These Terms of Service ("Terms") govern your use of the JapanBuySell website and mobile app (the "Service"), a marketplace for vehicles, parts and other goods in Japan. By creating an account or using the Service you agree to these Terms.
1. Eligibility & account
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for keeping your account credentials secure and for all activity under your account. Provide accurate contact information and keep it up to date so buyers and sellers can reach you.
2. The marketplace
JapanBuySell is a venue that connects buyers and sellers. We are not a party to any transaction between users, we do not take possession of listed items, and we do not guarantee the quality, safety, legality, or accuracy of any listing. Transactions, payments for items, inspections, handover and shipping are arranged directly between users.
3. Listings and content
- You are responsible for your listings, messages, photos and other content, and you must have the right to sell what you list and to post the content you upload.
- You may list an item with a price or as free. Listings must be accurate and not misleading.
- You grant us a non-exclusive licence to host and display your content for the purpose of operating the Service.
4. Prohibited conduct
You agree not to:
- List or sell anything illegal, stolen, counterfeit, or restricted for sale in Japan;
- Post false, fraudulent, harassing, hateful, or infringing content;
- Spam, scrape, or attempt to disrupt or gain unauthorised access to the Service;
- Use the Service to harass other users or share others' personal information without consent.
5. Messaging, location & photos
The Service lets you message other users, share your current location, and send photos. Only share a location or information you are comfortable disclosing to the other participant. Do not use messaging for abusive or unlawful purposes.
6. Pro subscriptions
Optional Pro features (such as unlimited active listings and a business storefront) are offered as a paid subscription processed by our payment provider. Fees, billing cycles and any renewal terms are shown at the point of purchase.
7. Reporting & moderation
You can report listings or users that violate these Terms. We may remove content, limit features, or suspend or terminate accounts that violate these Terms or harm the community, at our discretion.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that listings or users are trustworthy. You use the Service and transact with other users at your own risk.
9. Limitation of liability
To the maximum extent permitted by law, JapanBuySell is not liable for any indirect, incidental, or consequential damages, or for disputes, losses or damages arising from transactions between users or from your use of the Service.
10. Indemnity
You agree to indemnify and hold JapanBuySell harmless from claims arising out of your content, your transactions, or your violation of these Terms.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or its users.
12. Governing law
These Terms are governed by the laws of Japan, and disputes are subject to the courts of Japan, without regard to conflict-of-laws rules.
13. Changes
We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the updated Terms.
